1. Acceptance of Terms
By creating an account or using MerchGuard ("the Service") you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
MerchGuard is an automated compliance-scanning tool for print-on-demand marketplace listings. The Service surfaces potential policy or intellectual-property risks based on public data and AI analysis. Results are advisory only and do not constitute legal advice or any guarantee of marketplace acceptance.
3. Account & Eligibility
You must be at least 18 years old and able to form a binding contract. You are responsible for safeguarding your credentials and for all activity on your account.
4. Plans & Billing
The Free plan is permanent within posted limits. Paid plans (Starter, Pro, Team) are billed monthly through our payment processor (Lemon Squeezy or Stripe). You can cancel anytime; cancellation stops future renewals but does not refund the current period.
5. Acceptable Use
- · Don't scrape, resell, or rate-limit-bypass the Service.
- · Don't use the Service to facilitate clearly infringing or illegal listings.
- · Don't reverse-engineer the detection prompts or attempt to bulk-extract our policy database.
6. Intellectual Property
The MerchGuard name, logo, methodology, prompts, rule database, and code are owned by us. Listing content you submit remains yours; you grant us a limited license to process it for the purpose of generating your scan results.
7. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not warrant that scan results will catch every violation, that flagged items are actually infringing, or that the Service will be uninterrupted or error-free. Marketplaces (Etsy, Amazon, etc.) make their own independent policy decisions.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD 50. We are not liable for lost profits, lost listings, marketplace suspensions, or indirect / consequential damages.
9. Termination
You can delete your account at any time from /app/settings. We may suspend or terminate accounts that violate these Terms.
10. Governing Law
These Terms are governed by the laws of Hungary, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Budapest, Hungary.
11. Changes
We may update these Terms; material changes will be announced on the Service or via email at least 14 days before taking effect.
